Result Rent Check for self-contained accommodations

What can you do with the result of the Rent Check? This will depend on how many points the accommodation is awarded and the maximum rent commensurate with this, but also on when the rental contract for the accommodation was concluded (signed) and on the current rent for the accommodation.

Good to know:

  • The maximum rent in this summary is the maximum rent without any potential surcharge for monuments and/or new buildings.
  • The Rent Check is based on the housing valuation system. Nevertheless, the result may differ slightly from reality, for example due to a measurement error or because a question was understood differently from how it was intended. Therefore, when assessing the rent, the Rent Tribunal always starts from a new points score, which is set by a Rent Tribunal investigator or another expert.

The accommodation falls within the social sector, but the rent falls within the private sector. The landlord has 1 year to adjust the rent. After that, the tenant is entitled to rent protection.

That means:
The landlord has until 1 July 2025 to adjust the rent to no higher than the maximum rent according to the Rent Check. What if that does not happen? The tenant can then propose a rent reduction as of 1 July 2025 and, if necessary, ask the Rent Tribunal to assess the rent.
